Detailed APG Eastern Avionics International, Inc. contest/sweepstakes rules and prize policies: We limit our contests to one winner per household. Some contests have additional restrictions that will be posted on the avionix.com website as needed. Unless otherwise posted, APG Eastern Avionics International, Inc. contests are open to all legal U.S. residents. Contestants must be 18 years old or older to win and/or claim prizes with a retail value of $100 or more. Employees of APG Eastern Avionics International, Inc., and its sister companies and members of the immediate families or households of said individuals are not eligible. Owners, directors, and employees of business entities that are primary sponsors of any contest or promotion, and the members of the immediate families or households of such individuals are not eligible to participate in the particular contest(s) with which their business entities are associated. Owners, directors and employees of business entities of whatsoever nature that are engaged in the same or similar types of business as that of APG Eastern Avionics International, Inc. and the members of the immediate families or households of such individuals are not eligible. Unless otherwise posted, only one member of an immediate family or household may win a “major prize” ($100 value or more) in any single contest or promotion. Upon the winning of a major prize by one member of an immediate family or household, he or she and all other members of his/her immediate family and/or household become ineligible to participate further in that contest or promotion. No purchase is necessary to participate in any APG Eastern Avionics International, Inc. contest or sweepstakes. Payment of any taxes and/or fees associated with the acceptance of any prize is the sole responsibility of the winner of the prize. Each winner must accept the prize or equivalent substitute prize(s) as offered. Winners may be required to sign a release form or other certifying documents prior to being awarded their prizes. Except where prohibited, participation in the Sweepstakes constitutes the participant's consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation or further compensation. By participating, entrants agree, on behalf of themselves, their executors, assigns and heirs, (a) to abide by all the rules and the decisions of the management of APG Eastern Avionics International, Inc., which shall be final in all matters relating to all contests and sweepstakes; (b) release and hold harmless APG Eastern Avionics International, Inc. its sister companies and their respective directors, officers and employees from any and all liability, claims, or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of any prize or when preparing for, participating in, and/or traveling to any prize-related or contest related activity associated in any manner whatsoever with APG Eastern Avionics International, Inc. contests and/or sweepstakes; and (c) that APG Eastern Avionics International, Inc. nor any of the aforementioned entities are responsible for damaged, late, lost, misdirected entries or communications. Prize winners, by accepting a prize, acknowledge that APG Eastern Avionics International, Inc. has neither made nor is in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize or part thereof. The management of APG Eastern Avionics International, Inc. reserves the right in their sole discretion to modify or discontinue any game, contest, or sweepstakes at any time with notice in the event technical or human error or other circumstance corrupt its conduct or operation; and in the event of such cancellation to award announced prizes by an alternate method. The Sweepstakes will begin at 10 a.m. (EST) on June 15, 2008 and will continue to 11:59 p.m. (EST) on September 15, 2008 (the "Sweepstakes Period"). Any and all recipients who, during the Sweepstakes Period, register on-line as a new customer by completing all of the required on-line information and follow all instructions will be entered in the sweepstakes. Customers who purchase by any means; on-line, telephone, FAX, or e-mail from APG Eastern Avionics Intl., Inc. during the contest period will automatically be entered in the sweepstakes. Submit your entry by clicking on the "Click HERE to Register as a Customer and Enter the Sweepstakes!" link on the www.avionix.com/contest.html web page. APG Eastern Avionics International, Inc.will not be responsible for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, the malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the email account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account. Any questions regarding the number of entries submitted or the owner of an email account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Sweepstakes. Odds of winning depend on the number of eligible entries received. The Sweepstakes may be presented in multiple presentations and in other media, and the odds of winning may depend on the number of eligible participants who enter the Sweepstakes through such multiple presentations. Winners will be notified by telephone or email within 10 days of each drawing. The winner's first name, last initial and home city/state will also be posted on the Avionix.com website after the winner has been notified and his/her eligibility confirmed. Winner may waive his/her right to receive the prize. The prize is not assignable and is not transferable. The winner may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (14) days of date of postmark. Failure to sign and return the affidavit or release within ten (14) days, or to comply with any term or condition of these Official Rules, will result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate winner. By participating, participants agree to be bound by these Official Rules and the decisions of the judges. Participants are agreeing to allow Sponsor to periodically send them savings and news emails to the email address provided by participants. APG Eastern Avionics International, Inc.reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Sweepstakes as solely determined by Sponsor. In the event the Sweepstakes is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Sweepstakes, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, Sponsor reserves the right to award the prizes based on the entries received before the termination date. By entering the Sweepstakes, participants agree that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstake, or any prizes awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will any participant be permitted to obtain any award for, and participant waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant and Sponsor, shall be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether of Florida, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Florida. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.By entering the Sweepstakes, participants release APG Eastern Avionics International, Inc., any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Sweepstakes or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
